In a landmark victory for science, common sense, and the protection of women and children, North Carolina’s House Bill 805 has gone into effect, formally recognizing that there are only two sexes: male and female.

 

Effective January 1, 2026, this groundbreaking legislation anchors state policy in undeniable biological truth, defining sex based solely on reproductive potential and objective indicators present at birth.

 

The bill’s clear and precise definition of “biological sex” states: the “biological indication of male and female in the context of reproductive potential or capacity, such as sex chromosomes, naturally occurring sex hormones, gonads, and non-ambiguous internal and external genitalia present at birth, without regard to an individual’s psychological, chosen, or subjective experience of gender.”

 

Thankfully, the bill’s language cuts through any misinterpretation or confusion in order to come in line with what biology has always taught: sex is binary, immutable, and rooted in reality.

 

Sponsored by Republican Rep. Neal Jackson, HB 805 aligns North Carolina with federal standards set by President Donald Trump’s Executive Order 14168, “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.” As Rep. Jackson explained, “It’s just biology defining, so state law meets up with federal mandate and what biology says.” This synchronization ensures clarity, protects federal funding eligibility, and defends women’s rights against ideological overreach.

 

What began as a bipartisan effort to combat malicious pornography evolved into a comprehensive shield for vulnerable North Carolinians. The bill includes robust measures to prevent sexual exploitation, requiring age verification and written consent for individuals depicted in pornographic content. Rep. Jackson, drawing from his 18 years as a pastor, highlighted the human cost: “There are so many sexual predators out there,” and countless people trapped in the industry from a young age.

 

Provisions within the bill will empower survivors to revoke consent and remove exploitative images, which has been a difficult process up until today.

 

Beyond pornography protections, HB 805 safeguards children and families in meaningful ways:

 

  • Bans state funding for gender transition procedures on minors.
  • Empowers parents to opt children out of classroom materials conflict with their religious beliefs.
  • Grant’s parents have access to review school library books.
  • Requires separate sleeping quarters for male and female students on school overnight trips, prioritizing privacy and safety.

 

Despite Governor Josh Stein’s veto of the bill, where he dismissed these protections as “mean-spirited,” the Republican-led legislature rightly overrode it, recognizing the bill’s vital role in upholding truth and safeguarding the innocent.

 

Critics, including the ACLU, have decried the law for “imposing rigid definitions,” clearly revealing how they’ve missed the point: biology isn’t rigid, it’s fact.

 

North Carolina’s courageous step rejects harmful ideology, protects women’s spaces and sports, and ensures policies reflect reality rather than subjective feelings. By grounding policy in biological truth, North Carolina leads the nation in common-sense governance, proving that standing firm on science strengthens society for everyone.
