SCOTUS Upholds Tennessee Ban on Trans Hormones for Children

In a historic 6-3 decision, the U.S. Supreme Court reaffirmed Tennessee’s prohibition against gender-affirming medical treatments, such as puberty blockers and hormone therapy, for children.

The United States v. Skrmetti ruling is a victory of sound policies placing the welfare of children above unproven medical procedures.

Tennessee’s 2023 legislation, SB1, rightfully prohibits healthcare workers from providing irreversible care to children for gender transition, and the Court ruling permits states to protect vulnerable children.

Chief Justice John Roberts, empowering the conservative majority, clarified that the law does not discriminate on the basis of transgender status or sex but makes medical treatment contingent on age and purpose. He stressed that the scientific uncertainties about the long-term effects of gender-affirming care, which is debated even amongst doctors, make it proper to entrust such issues to democratically elected state lawmakers instead of activist judges.

This ruling upholds the idea that the states and not the courts must decide complex policy issues.

Tennessee Attorney General Jonathan Skrmetti hailed the decision as a “landmark victory” to safeguard children from untested procedures with potential long-term complications.

This law is a significant and necessary protective measure for the safety of children who are not yet mature enough to make irreversible medical decisions, the law also empowers concerned parents and doctors who are also in need of protections to prevent those seeking to hastily rushing in with medical interventions.

The dissent, led by Justice Sonia Sotomayor, contended that the law is discriminatory against transgender children, but those who voted in the majority contend that it protects all children equally by halting unsafe procedures until adulthood.

Since 25 states have already enacted such prohibitions, and mounting evidence questions the safety of such treatments, the decision validates Tennessee’s stance and sets a precedent for other states. So in the end, this case has resulted in a win for parents’ rights, children’s welfare, and legislative authority in a contested culture war.
