Will Harris Be Denied Access to Biden’s War Chest?

$91 million dollars sit in President Biden’s campaign war chest, but with him dropping out of the race for the White House as the potential Democratic nominee, the question arises – who will have control over the funds?

Attorneys for former President Trump filed a complaint with the Federal Election Commission (FEC) this week which argued Vice President Kamala Harris has no legal right to access funds which were raised for President Biden, and if they were accessed, this would be a violation of campaign finance law.

FEC regulations currently state that each candidate must have campaign committees who raise money for them. These committees would then be tasked with fundraising for their candidate.

After President Biden dropped out as the Democratic nominee for President, he swiftly endorsed Harris for the position and she accepted.

However, Harris didn’t follow proper procedure and has simply replaced her name on pre-existing documents pertaining to donor dollars raised for Biden.

When it comes to FEC regulations, this is a no go.

Previously, filings with the FEC connected to the funds showed they belonged to and were raised by the Biden for President committee, but now they show as belonging to the Harris for President committee.

Access to the funds can only come IF Kamala Harris becomes the Democrat Party presidential nominee.

Why is this so?

Because, upon registering with the FEC, the Biden for President committee registered itself as the “principal campaign committee” for Joe Biden and Kamala Harris.

If Kamala Harris doesn’t become the presidential nominee, she will not be permitted to access the $91.5 million and the new nominee would be prohibited from accessing the $91.5 million.

The only course of action available to the new candidate would be for the Biden for President campaign committee to give a $2,000 contribution to the new presidential nominee’s campaign committee. That’s it.

David A. Warrington, President Trump’s general counsel, stated in the complaint issued to the FEC:

“This is little more than a thinly veiled $91.5 million excessive contribution from one presidential candidate to another, that is, from Joe Biden’s old campaign to Kamala Harris’s new campaign.”

“Contributions by federal candidate committees to other federal candidates are limited to $2,000.”

At this time, neither Biden nor Harris have been confirmed as the Democratic nominee, and as such, they cannot use cash from the campaign committee.

Commenting further on the issues, Trump’s campaign stated:

“Kamala Harris is in the process of committing the largest campaign finance violation in American history … and she is using the Commission’s own forms to do it.”
