Israeli P.M. to be Arrested What You Need to Know - Encounter Today - Blog

BREAKING: International Criminal Court (ICC) Prosecutor Karim Khan has announced applications for arrest warrants in relation to Israeli Prime Minister Benjamin Netanyahu and Defense Minister, Yoav Gallant.

Warrants were also issued for Hamas leader Yahya Sinwar.

Leaders on both sides of the conflict happening in Gaza since the October 7th terrorist attacks by Hamas in Israel against Israeli citizens, allegedly constitute as “war crimes.”

ICC prosecutor Karim Khan said in a statement that based on evidence collected and examined by his office, he has “reasonable grounds” to believe Netanyahu and Gallant “bear criminal responsibility for… war crimes and crimes against humanity committed on the territory of the State of Palestine.”

He also says alleged crimes include “starvation of civilians as a method of warfare” and “intentionally directing attacks against a civilian population.”

Khan’s statement read that, “The independent judges of the International Criminal Court are the sole arbiters as to whether the necessary standard for the issuance of warrants of arrest has been met.”

“Should they grant my applications and issue the requested warrants, I will then work closely with the Registrar in all efforts to apprehend the named individuals.”

Israel’s war cabinet member and opposition leader Benny Gantz condemned the ICC’s announcement, saying “the prosecutor’s position to apply for arrest warrants is in itself a crime of historic proportion to be remembered for generations.”

“While Israel fights with one of the strictest moral codes in history, while complying with international law and boasting a robust independent judiciary – drawing parallels between the leaders of a democratic country determined to defend itself from despicable terror to leaders of a blood-thirsty terror organization is a deep distortion of justice and blatant moral bankruptcy,” he added.

Here is what you won’t read elsewhere about the ICC:

First off, this move by the ICC reveals the international community’s skewed priorities and double standards.

Secondly, this move is meant to delegitimize Israel and her democratically elected leaders, by doing so, the ICC is only delegitimizing herself. (Note: we understand there are concerning events which have taken place since the October 7th terrorist attacks within Israel, one of the peak points of interest was an election that was about to take place domestically but was halted due to the attack and how the outcome of that election would have, possibly, ousted the current Prime Minister Netanyahu).

Third, the ICC is crossing boundaries with this move. There has been zero investigating by the ICC and has proven this is being done for political means and out of prejudice.

Fourth, Russia actually benefits from this move because if the ICC is successful, Putin could say that this situation, along with his own dealings with the ICC, are proof that they’re illegitimate.

Fifth, our present situation falls under the Hague Invasion Act which states that any U.S. ally participating in an attempt to arrest an American or and American ally, they that country would itself be in the sights of the U.S.

The U.S., Israel and others are not a part of the ICC but many U.S. allies in Europe are. This brings us back to our previous point that the ICC has no jurisdiction over this matter. If action was taken based upon the ICC and geopolitical lines were shifted, the ICC would be blamed and the ramifications of this kind of situation would be catastrophic for the organization.

Finally, this move seeks to legitimize the ICC’s position as the world’s court. If successful, this would serve as a major blow to several nation’s sovereignty.

Proving these points, Representative Andy Barr stated on X:

“The International Criminal Court has no legitimate authority to infringe on the sovereign right of a democratic country to defend itself against terrorists. The U.S. must stand for Israel’s right of self-defense and immediately sanction ICC officials.”

After the news broke that the ICC was putting forward warrants, it was revealed that Amal Clooney, wife of Hollywood actor, George Clooney, was one of the lawyers who advised the ICC to pursue an arrest warrant against the Israeli Prime Minister.

The story continues to become more and more bizarre, especially after a line of questioning by the press during a U.S. State Department briefing took place.

State Dept. Spokesman Matt Miller, criticized the ICC’s investigation into alleged war crimes, suggesting Palestinians should rely on Israeli investigations for any war crimes committed by Israel, implying that the ICC’s involvement is unnecessary.

To this, a journalist asked the question: “Who does have jurisdiction here?” To this Miller replied, “Israel.”

Perplexed, the journalist pushed the envelope further stating: “So if Palestinians have complaints they have to go to Israeli courts.” Miller responded saying, “We have jurisdiction.” This response is a bizarre statement, to say the least. “I’m sorry how do you have jurisdiction…the U.S. has no jurisdiction here,” the journalist replied.

Miller said the quiet part out loud.

International institutions have no real jurisdiction. It’s only the U.S. who has jurisdiction. Everything else is just smoke, and mirrors to give the impression that due process and accountability actually exists.

This smearing of the ICC by the Biden Administration sparked controversy within the press room seeing as the Biden Administration was all in favor of the ICC’s ruling that targeted Russian President Vladimir Putin, calling for his arrest just last year.

A reporter asked: “Does this undermine the ICC as a whole? You support ICC in Ukraine, yet not here?” To this, Miller responded, “ICC has done important work to hold people accountable for war crimes and crimes against humanity… but we have great concerns.”

Mhmm…

HISTORY

The United Nations General Assembly established the ICC by way of the Rome Statute in 1998 and began operating in 2002 as the first and only permanent international court with jurisdiction over genocide, crimes against humanity, crimes of aggression and war crimes.

18 judges oversee the ICC and are elected by the 23 countries that formally participate in it. The United States is not one of them.

The intent of the court is to serve as the “court of last resort” and complements existing national judicial systems. It “may exercise its jurisdiction only when national courts are unwilling or unable to prosecute criminals.”

Conclusion

Israel and the U.S. are not members of the ICC, and as such, neither of these two countries recognize its jurisdiction. In 2015, however, the Palestinian Authority became a member of the ICC.
