Biden’s Department of Justice (DOJ) has filed a lawsuit against the State of Tennessee for making it illegal for prostitutes to knowingly spread HIV.

The DOJ says that the law is a violation of the Americans with Disabilities Act and discriminates against people living with HIV.

Essentially, what Biden’s DOJ is fighting to establish is that it’s discriminatory for prostitutes to NOT be able to spread HIV to others.

This is wild!

The DOJ has requested that one person mentioned in the lawsuit, and “other aggrieved individuals” be awarded compensatory damages for being convicted under the law including registry fees, court costs and fines, bonds and attorney’s fees.

At present, Tennessee is the only state which imposes a lifetime registration as a “violent sex offender” if convicted of taking part in prostitution whilst living with HIV, regardless of whether the individual knew they could transmit the disease.

“The enforcement of state criminal laws that treat people differently based on HIV status alone and that are not based on actual risks of harm, discriminate against people living with HIV,” said Assistant Attorney General Kristen Clarke of the Justice Department’s Civil Rights Division in a press release. “People living with HIV should not be subjected to a different system of justice based on outdated science and misguided assumptions. This lawsuit reflects the Justice Department’s commitment to ensuring that people living with HIV are not targeted because of their disability.”

In addition to this lawsuit is a federal lawsuit that was filed by several LGBT organizations like OUTMemphis on behalf of four “Jane Doe” plaintiffs over the State’s aggravated prostitution law in October of 2023.

In Tennessee, if someone is convicted of aggravated prostitution, a Class C felony, they would face between three and 15 years in prison and a fine of up to $10,000.

The DOJ has requested a judge order Tennessee to cease in its enforcement of its aggravated prostitution law and to have the records removed and expunged of anyone on the sex offender registry if they have a conviction under this specific law.

Tennessee’s Senate passed a bill that would remove requirements for a convicted sex offender to be registered whilst facilitating a way for convictions to be expunged. Meanwhile, Democratic State Representative Torrey Harris and Democratic State Senator Jeff Yarbro brought forward a bill to remove the law from the books if passed.
