Pro-Abortion Biden FAILS In Court Against Texas

Joe Biden has been blocked by a federal appeals court after attempting to force Texas emergency rooms and hospitals to commit abortions.

In 2022, the Biden administration informed hospitals that Medicare funds would be withheld by the government unless they performed abortions describing them as a “necessary stabilizing treatment.”

The state of Texas, alongside pro-life physicians, initiated a lawsuit challenging Biden’s impending abortion mandate which a federal judge prevented. As such, the Biden administration appealed to the Fifth Circuit Court of Appeals and lost the case.

Biden’s Department of Health and Human Services (HHS) and the Centers for Medicare & Medicaid Services issued a mandate that distorted a federal law which would prevent hospitals from delaying emergency treatment for pregnant mothers or vulnerable patients if they came to the ER, this law is called the Emergency Medical Treatment And Labor Act (EMTALA). Biden’s directive perverted the provisions of EMTALA by labeling abortion as “stabilizing treatment.”

The three judges presiding over the case, Leslie Southwick, Kurt Engelhardt, and Cory Wilson, unanimously ruled that federal law doesn’t require hospitals to commit abortions and that the Biden administration cannot withhold Medicare funds if they refuse to do so.

Judge Engelhardt wrote that the policy urges physicians to stabilize both the mother and the preborn child: “We agree with the district court that EMTALA does not provide an unqualified right for the pregnant mother to abort her child especially when EMTALA imposes equal stabilization obligations.”

This policy was utterly useless seeing as states already permit doctors to intervene in situations where the mother’s life is at risk and serves as further proof of the disdain for life the Biden’s administration has and it reeks to high heaven. This administration is intentionally seeking out new avenues to not only have abortions committed but to penalize those who refuse to commit them.

Understand, just because a bad law or mandate has been issued, doesn’t mean it can stand.

This great nation has several legal protections that have stood the test of time and will continue to serve the citizens above corrupt and immoral lawmakers.
